MyGeoVerse Terms of Use

1. Agreement to These Terms

These Terms of Use (“Terms”) are a legally binding agreement between you and VR Masters, LLC, doing business as XR Masters (“XR Masters,” “we,” “our,” or “us”) governing your access to and use of MyGeoVerse.

MyGeoVerse is a product and brand of VR Masters, LLC (DBA XR Masters).

These Terms apply to:

the MyGeoVerse website;
MyGeoVerse mobile applications for iOS and Android;
the MyGeoVerse Spatial Browser;
the MyGeoVerse Dashboard;
the MyGeoVerse Backoffice;
creator and administrative tools;
developer tools and APIs where made available;
MyGeoVerse applications and experiences for smartphones, tablets, smart glasses, augmented reality (“AR”), mixed reality (“MR”), virtual reality (“VR”), extended reality (“XR”), and other compatible devices;
MyGeoVerse beta programs and Testbed Programs;
MyGeoVerse AI-powered features; and
other MyGeoVerse services or features that reference these Terms.

Collectively, these are referred to as the “MyGeoVerse Services” or the “Services.”

By creating an account, selecting an acceptance checkbox or button, participating in an applicable Testbed Program, or otherwise accessing or using the Services after being presented with these Terms, you acknowledge that you have read and agree to be bound by these Terms and the applicable MyGeoVerse Privacy Policy.

If you do not agree to these Terms, you must not access or use the Services.

2. Operator

3. Privacy

Your use of MyGeoVerse is also subject to the MyGeoVerse Privacy Policy, which explains how XR Masters collects, processes, uses, shares, retains, and protects information relating to MyGeoVerse users.

The general XR Masters Privacy Policy also applies at the company and developer level.

The Privacy Policy is incorporated into these Terms by reference for purposes of explaining our privacy practices but does not expand contractual rights beyond those provided by applicable law or these Terms.

4. Eligibility

You may use MyGeoVerse only if you are legally permitted to enter into these Terms and use the Services under applicable law.

If you are under the age at which you may independently enter into a binding agreement in your jurisdiction, you may use MyGeoVerse only with the authorization of a parent, legal guardian, educational institution, or other authorized party where permitted by applicable law.

Children under 13 may not independently create or use a MyGeoVerse account except within an authorized educational, institutional, research, Testbed, or supervised environment that satisfies applicable legal requirements.

Additional consent, authorization, or participation requirements may apply to minors participating in MyGeoVerse Testbed Programs.

5. Accounts

Certain MyGeoVerse Services require an account.

When creating or using an account, you agree to:

provide accurate and current information;
maintain the accuracy of your account information;
keep your login credentials confidential;
not share credentials with unauthorized persons;
promptly notify XR Masters if you believe your account has been compromised; and
take responsibility for activities conducted through your account to the extent permitted by applicable law.

You may not:

impersonate another person or organization;
create an account using false or misleading information;
obtain unauthorized access to another user’s account;
transfer or sell an account without authorization from XR Masters; or
circumvent account restrictions or access controls.

XR Masters may require verification of account information where reasonably necessary for security, program administration, legal compliance, or account recovery.

6. User Testers and Testbed Testers

MyGeoVerse may support different types of testers and participants.

User Tester

A User Tester is an individual who participates directly in a MyGeoVerse beta, testing, demonstration, pilot, or similar program.

Testbed Tester

A Testbed Tester is an individual who participates through a MyGeoVerse Testbed Partner.

A Testbed Partner may include:

an educational institution;
university;
school;
technology center;
research organization;
business;
governmental organization; or
other approved participating organization.

The technical credentials or functionality available to User Testers and Testbed Testers may be similar, but their administrative relationships and participation conditions may differ.

A Testbed Partner may establish additional legitimate rules for participation in its Testbed Program, provided those rules do not override these Terms or applicable law.

A Testbed Partner may also manage or request changes to access associated with its authorized participants where permitted by the applicable Testbed arrangement.

7. Beta and Testbed Services

Some MyGeoVerse Services may be offered as beta, preview, experimental, pilot, prototype, testbed, pre-release, or evaluation functionality.

Such functionality may:

contain bugs or errors;
change without notice;
be incomplete;
operate differently across devices;
experience interruptions;
lose or fail to synchronize data;
be modified or discontinued;
have limited support; or
not be suitable for production-critical use.

You understand that beta and Testbed Services are provided primarily for testing, evaluation, research, training, demonstration, development, or feedback purposes.

You should not rely on beta or Testbed Services for emergency services, safety-critical operations, mission-critical navigation, medical decisions, or other activities where failure could cause serious harm.

XR Masters may modify, restrict, suspend, or discontinue beta or Testbed functionality at any time.

8. License to Use MyGeoVerse

Subject to your compliance with these Terms, XR Masters grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the MyGeoVerse Services for their intended purposes.

This license does not transfer ownership of MyGeoVerse or any XR Masters intellectual property to you.

Except where expressly authorized by XR Masters or permitted by applicable law, you may not:

copy or reproduce the Services;
modify or create derivative works from XR Masters software;
sell, rent, lease, sublicense, or commercially redistribute the Services;
reverse engineer, decompile, or attempt to extract source code;
circumvent security or access controls;
access non-public systems or APIs without authorization;
scrape or systematically extract data from the Services;
interfere with the operation or security of the Services; or
use MyGeoVerse intellectual property outside the scope of the permission granted by these Terms.

Nothing in these Terms limits rights that cannot lawfully be restricted.

9. XR Masters and MyGeoVerse Intellectual Property

MyGeoVerse and the technology associated with it may include:

software;
source and object code;
user interfaces;
designs;
trademarks;
logos;
databases;
spatial-computing technology;
APIs;
workflows;
documentation;
graphics;
audiovisual elements;
AI-related technology;
navigation functionality;
AR experiences; and
other proprietary materials.

Except for User Content or third-party material, these materials are owned by or licensed to XR Masters and are protected by applicable intellectual-property laws.

MyGeoVerse, XR Masters, related logos, and associated branding may not be used without authorization except as permitted by applicable law.

10. User and Creator Content

MyGeoVerse may allow users, creators, developers, organizations, customers, Testbed Partners, or administrators to create, upload, publish, store, manage, or distribute content (“User Content”).

User Content may include:

Points of Interest (“POIs”);
text;
photographs;
video;
audio;
2D or 3D assets;
models;
avatars;
Smart Assets;
scenes;
spatial experiences;
geographic coordinates;
GeoPose information;
spatial anchors;
navigation information;
descriptions;
metadata; and
other digital content.

You retain ownership of intellectual-property rights you hold in your User Content.

You are responsible for ensuring that you have all rights, permissions, licenses, and authorizations necessary to submit and use User Content through MyGeoVerse.

11. License You Grant to XR Masters

By uploading, publishing, storing, or otherwise making User Content available through MyGeoVerse, you grant XR Masters a non-exclusive, worldwide license to host, store, reproduce, process, transmit, display, format, adapt as technically necessary, and distribute that User Content solely as reasonably necessary to:

operate MyGeoVerse;
display the content to authorized users;
associate content with locations or spatial anchors;
synchronize content across MyGeoVerse Services;
provide spatial experiences;
allow authorized AI or Smart Asset functionality to interact with the content;
provide navigation and discovery;
maintain backups;
provide technical support; and
otherwise perform the functionality you requested.

This license does not transfer ownership of your User Content to XR Masters.

The license continues for as long as the content is maintained through the Services and for a reasonable period afterward where technically necessary for backup, security, legal, or operational purposes.

Publicly published content may remain visible until it is removed from the relevant Service, subject to applicable retention obligations.

12. Prohibited User Content and Conduct

You may not use MyGeoVerse to create, upload, publish, distribute, communicate, or facilitate content or conduct that:

violates applicable law;
infringes intellectual-property or proprietary rights;
violates privacy, publicity, confidentiality, or data-protection rights;
contains malicious software or harmful code;
is fraudulent, deceptive, or intentionally misleading;
impersonates another person or organization;
promotes or facilitates criminal activity;
contains credible threats of violence;
harasses, bullies, stalks, or abuses another person;
exploits or endangers children;
contains unlawful sexual content;
distributes another person’s sensitive personal information without authorization;
interferes with MyGeoVerse systems or users;
attempts unauthorized access to systems, accounts, networks, or data;
manipulates localization, geospatial, or navigation functionality for malicious purposes;
creates dangerous or intentionally misleading spatial guidance;
uses automated systems to overload or abuse the Services;
circumvents moderation, safety, or security systems; or
otherwise materially violates these Terms.

XR Masters may remove, restrict, disable, or limit access to content that violates these Terms or applicable law.

13. User-Generated Content Moderation

Where MyGeoVerse permits User Content to be made visible or accessible to other users, XR Masters may operate moderation and safety mechanisms appropriate to the relevant feature.

These may include:

content review;
reporting mechanisms;
filtering mechanisms;
content removal;
account restrictions;
blocking functionality;
investigation of reported abuse; and
suspension or termination of accounts.

Users may report content or behavior they reasonably believe violates these Terms through reporting functionality provided in the relevant Service or by contacting XR Masters.

Where applicable functionality allows direct interaction between users, MyGeoVerse may provide mechanisms for users to block other users.

XR Masters reserves the right, but does not undertake a general obligation, to monitor all User Content.

XR Masters may act on reports and remove or restrict content where reasonably necessary to enforce these Terms, protect users, comply with law, or satisfy application-platform requirements.

14. Intellectual-Property Complaints

XR Masters respects the intellectual-property rights of others.

If you believe content made available through MyGeoVerse infringes your copyright, trademark, or other intellectual-property rights, you may contact XR Masters with sufficient information to identify:

the protected work or right;
the allegedly infringing material;
its location within MyGeoVerse;
your contact information; and
the basis of your claim.

XR Masters may remove or restrict access to allegedly infringing content where appropriate and may terminate repeat infringers where required by applicable law.

15. Location, AR, Navigation, and Spatial Safety

MyGeoVerse may provide geospatial discovery, localization, AR placement, POIs, navigation, wayfinding, spatial recommendations, or other location-based functionality.

You acknowledge that:

GPS, VPS, sensors, maps, spatial anchors, GeoPose, and localization technologies may contain errors;
digital content may not perfectly correspond to the physical environment;
device positioning may change or become inaccurate;
Points of Interest may contain outdated or inaccurate information;
navigation routes or spatial guidance may not account for every physical hazard, restriction, or environmental condition; and
AR content may distract you from your surroundings.

You are responsible for remaining aware of your physical environment.

Do not use MyGeoVerse in a manner that interferes with safe:

walking;
driving;
cycling;
operating machinery;
crossing roads;
entering restricted areas; or
navigating dangerous terrain.

Always obey:

traffic laws;
posted signs;
property restrictions;
venue rules;
safety instructions;
law-enforcement directions; and
applicable laws.

MyGeoVerse is not an emergency-navigation system and should not be relied upon for emergency response, evacuation, rescue, or life-safety decisions.

16. Points of Interest and Third-Party Locations

POIs and spatial content available through MyGeoVerse may be created by:

XR Masters;
users;
creators;
customers;
venues;
Testbed Partners;
commercial partners; or
other authorized third parties.

Unless expressly stated otherwise, XR Masters does not guarantee that third-party POI information is:

complete;
current;
accurate;
accessible;
safe;
open to the public; or
suitable for a particular purpose.

The inclusion of a location, business, venue, product, service, attraction, or POI in MyGeoVerse does not necessarily constitute an endorsement by XR Masters.

Users remain responsible for complying with the rules and access restrictions applicable to physical locations.

17. AI-Powered Features

MyGeoVerse may include:

AI Companions;
conversational agents;
intelligent avatars;
Smart Assets;
recommendation systems;
virtual guides;
generative AI;
speech-enabled assistants; and
other AI-powered functionality.

AI-generated content may be inaccurate, incomplete, outdated, misleading, or inappropriate for a particular situation.

You should independently evaluate information produced by AI features before relying upon it.

AI-generated information is not intended to replace professional advice.

You should not rely upon MyGeoVerse AI features as a substitute for qualified:

medical;
legal;
financial;
engineering;
safety;
emergency;
or other professional advice.

You are responsible for how you use AI-generated information and outputs.

XR Masters may use third-party AI providers to support certain functionality as described in the MyGeoVerse Privacy Policy.

18. Recommendations, Sponsored Content, and Commercial POIs

MyGeoVerse may provide:

location-based recommendations;
contextual recommendations;
promoted locations;
sponsored POIs;
venue recommendations;
sponsored experiences;
spatial advertising;
promotions; or
other commercial content.

Sponsored or promoted content may be identified as such where appropriate.

Recommendations may be influenced by factors including:

geographic proximity;
spatial context;
venue information;
available POIs;
user-selected interests;
contextual relevance;
commercial relationships; or
other factors relevant to the Service.

XR Masters does not guarantee the availability, quality, safety, accuracy, price, or suitability of third-party products, services, venues, or experiences appearing in recommendations.

Any purchase, reservation, transaction, or agreement between you and a third-party provider is generally between you and that third party unless XR Masters expressly states otherwise.

19. Testbed Partners and Institutional Use

A Testbed Partner may use MyGeoVerse as part of:

education;
training;
research;
testing;
technology evaluation;
demonstrations;
pilots; or
other approved programs.

Testbed Partners are responsible for complying with the terms of their agreement with XR Masters and for using the Services only for authorized purposes.

Testbed Partners may establish reasonable participation requirements for their Testbed Testers.

Where minors participate, applicable privacy, parental-consent, educational, and safeguarding requirements must be satisfied as described in the MyGeoVerse Privacy Policy and applicable law.

Testbed participation does not transfer ownership of MyGeoVerse software, platform technology, or XR Masters intellectual property to the Testbed Partner or participants.

20. Feedback

You may voluntarily provide suggestions, ideas, comments, bug reports, feature requests, or other feedback concerning MyGeoVerse (“Feedback”).

You grant XR Masters permission to use Feedback without restriction or compensation to improve, develop, modify, commercialize, or otherwise operate MyGeoVerse and other XR Masters products.

This provision applies to Feedback about MyGeoVerse itself and does not transfer ownership of unrelated User Content or intellectual property.

Nothing in these Terms restricts your right to provide an honest review or opinion about XR Masters or MyGeoVerse.

21. Third-Party Services

MyGeoVerse may integrate with or rely upon third-party technology or services, including:

Apple;
Google;
cloud providers;
authentication providers;
AI providers;
speech-processing services;
mapping providers;
VPS providers;
localization providers;
device platforms; and
external websites or services.

Use of independent third-party services may be subject to the third party’s own terms and privacy policies.

XR Masters does not control independent third-party services and is not responsible for their separate acts or omissions except to the extent required by applicable law.

22. Availability and Changes to the Services

XR Masters may add, modify, update, limit, suspend, or discontinue features of MyGeoVerse.

We do not guarantee that:

every feature will always be available;
every feature will be supported on every device;
third-party integrations will remain available;
POIs or spatial content will remain permanently accessible;
beta functionality will become a production feature; or
the Services will operate without interruption or error.

Where reasonably practicable, XR Masters may provide notice of material changes affecting established Services.

23. Suspension and Termination

XR Masters may suspend, restrict, or terminate access to MyGeoVerse where reasonably necessary because of:

violation of these Terms;
unlawful conduct;
security concerns;
fraud or abuse;
infringement of third-party rights;
risks to other users or the Services;
Testbed or program expiration;
unauthorized access;
noncompliance with applicable program requirements; or
legal or regulatory requirements.

Where appropriate, XR Masters may provide notice or an opportunity to correct a violation before termination.

Serious, unlawful, fraudulent, abusive, dangerous, or repeated violations may result in immediate suspension or termination.

You may stop using MyGeoVerse at any time.

Account and personal-data deletion are handled as described in the MyGeoVerse Privacy Policy.

24. Account Deletion

Users may initiate deletion of a MyGeoVerse account:

through account-management functionality within the MyGeoVerse application; or
through:

Account deletion removes the account and associated personal information subject to legitimate legal, security, fraud-prevention, accounting, dispute-resolution, and other retention exceptions described in the MyGeoVerse Privacy Policy.

Where the same MyGeoVerse account is used across the mobile applications, Dashboard, Backoffice, or other connected MyGeoVerse Services, account deletion applies to the connected account as described in the Privacy Policy.

25. Fees and Paid Services

Some MyGeoVerse Services may currently be offered without charge, including certain beta or Testbed functionality.

XR Masters may offer paid products, services, licenses, features, transactions, or commercial programs in the future or under separate customer agreements.

Before charging an individual user for a paid MyGeoVerse feature, XR Masters will provide applicable pricing and material payment terms.

Additional commercial, licensing, customer, or application-store terms may apply to paid Services.

Nothing in these Terms requires XR Masters to continue offering any Service without charge.

26. App Stores and Device Platforms

If you obtain MyGeoVerse through the Apple App Store, Google Play, or another application platform, your use may also be subject to that platform’s applicable terms.

These Terms are between you and XR Masters, not between you and the application-store operator, except where the platform’s mandatory terms provide otherwise.

The applicable platform operator is not responsible for providing maintenance or support for MyGeoVerse except as required by its own terms or applicable law.

XR Masters, not the platform operator, is responsible for addressing claims concerning MyGeoVerse to the extent required by applicable law.

27. Apple App Store Additional Terms

If you download MyGeoVerse from Apple’s App Store:

these Terms are between you and XR Masters, not Apple;
the license granted to you is limited to use of MyGeoVerse on Apple-branded products that you own or control, subject to Apple’s applicable usage rules, including permitted Family Sharing or similar features;
Apple has no obligation to provide maintenance or support for MyGeoVerse;
XR Masters is responsible for any warranties relating to MyGeoVerse to the extent they cannot lawfully be disclaimed;
Apple is not responsible for investigating or resolving claims concerning MyGeoVerse, including product-liability, regulatory, consumer-protection, or intellectual-property claims, except as required by law; and
Apple and its subsidiaries are third-party beneficiaries of these Terms with respect to your licensed use of the iOS application and may enforce the applicable provisions against you.

28. No Emergency or Professional Services

MyGeoVerse is a spatial-computing and technology platform.

It is not intended to provide:

emergency response;
emergency navigation;
medical diagnosis or treatment;
legal advice;
financial advice;
public-safety dispatch;
rescue services; or
guaranteed navigation or localization.

In an emergency, contact the appropriate local emergency services and follow official safety instructions.

29. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE MYGEOVERSE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

XR MASTERS DOES NOT WARRANT THAT THE SERVICES WILL:

BE UNINTERRUPTED;
BE ERROR-FREE;
BE COMPLETELY SECURE;
OPERATE ON EVERY DEVICE;
PRODUCE PERFECTLY ACCURATE LOCATION OR SPATIAL RESULTS;
PROVIDE ERROR-FREE AI OUTPUTS;
CONTAIN COMPLETE OR CURRENT POI INFORMATION; OR
MEET EVERY USER’S PARTICULAR REQUIREMENTS.

TO THE EXTENT PERMITTED BY LAW, XR MASTERS DISCLAIMS IMPLIED WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.

30. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, XR MASTERS AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATING TO THE SERVICES, INCLUDING LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, XR MASTERS’ TOTAL LIABILITY ARISING FROM OR RELATING TO YOUR USE OF THE SERVICES WILL NOT EXCEED THE GREATER OF:

THE AMOUNT YOU PAID DIRECTLY TO XR MASTERS FOR THE APPLICABLE MYGEOVERSE SERVICE DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR
US $100.

These limitations do not apply to liability that cannot lawfully be limited or excluded, including where applicable liability for fraud, willful misconduct, gross negligence, death, personal injury, or statutory consumer rights.

Some jurisdictions do not permit certain exclusions or limitations, so portions of this section may not apply to you.

31. Indemnification

To the extent permitted by applicable law, if you use MyGeoVerse on behalf of a business, organization, institution, creator operation, or commercial entity, you agree to defend, indemnify, and hold harmless XR Masters and its affiliates, officers, directors, employees, contractors, and agents from third-party claims, liabilities, damages, losses, and reasonable costs arising from:

your User Content;
your violation of these Terms;
your infringement of third-party rights;
your unlawful use of the Services; or
your organization’s unauthorized or improper deployment of MyGeoVerse.

This section does not require individual consumers to indemnify XR Masters where such an obligation is prohibited or restricted by applicable law.

32. Compliance With Laws

You agree to use MyGeoVerse in compliance with applicable laws and regulations.

You may not use the Services where prohibited by law or for unlawful purposes.

You are responsible for complying with laws applicable to your own activities, User Content, locations, deployments, and use of third-party content.

33. Export Controls and Sanctions

MyGeoVerse software and technology may be subject to United States export-control and sanctions laws.

You may not use, export, re-export, transfer, or make the Services available in violation of applicable export-control or sanctions requirements.

You represent that you will not knowingly use MyGeoVerse in a manner prohibited by applicable United States trade restrictions.

34. Governing Law

Except where the laws of your jurisdiction require otherwise, these Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles.

Nothing in this section deprives consumers of mandatory protections provided by the laws of their jurisdiction of residence.

35. Dispute Venue

To the extent permitted by applicable law, disputes arising out of or relating to these Terms or the MyGeoVerse Services that cannot be resolved informally will be brought in a state or federal court having jurisdiction over VR Masters, LLC in Delaware.

You and XR Masters consent to the jurisdiction of those courts to the extent permitted by applicable law.

If applicable consumer law gives you the right to bring a claim in another jurisdiction, this section does not eliminate that right.

36. Informal Resolution

Before initiating formal legal proceedings, you and XR Masters are encouraged to attempt to resolve disputes informally.

You may contact XR Masters with a description of the issue and requested resolution.

XR Masters may similarly contact you using the contact information associated with your account.

Nothing in this section prevents either party from seeking urgent injunctive or equitable relief where legally appropriate.

37. Changes to These Terms

XR Masters may update these Terms to reflect:

changes to MyGeoVerse;
new functionality;
changes to business practices;
legal or regulatory requirements;
security requirements;
application-store requirements; or
other legitimate operational needs.

When these Terms are updated, XR Masters will revise the Last Updated date.

Where required by law or appropriate because of a material change, XR Masters may provide additional notice and may require users to affirmatively accept the updated Terms before continuing to use certain Services.

Continued use after properly notified changes become effective constitutes acceptance to the extent permitted by applicable law.

38. Electronic Communications

By using MyGeoVerse, you agree that XR Masters may provide Service-related notices electronically, including through:

the application;
email;
the Dashboard or Backoffice;
the MyGeoVerse website; or
another electronic method associated with your account.

Service-related communications may include:

security notices;
account notices;
Testbed communications;
legal notices;
policy updates; and
operational information.

Marketing communications are handled separately and may be subject to additional consent or opt-out requirements.

39. Assignment

You may not assign or transfer your rights or obligations under these Terms without prior written permission from XR Masters, except where applicable law provides otherwise.

XR Masters may assign these Terms in connection with:

a merger;
acquisition;
corporate reorganization;
financing;
sale of assets; or
transfer of the MyGeoVerse business,

subject to applicable law.

40. Severability

If any provision of these Terms is found unenforceable or invalid, that provision will be enforced to the maximum extent permitted by law or, where necessary, severed.

The remaining provisions will continue in effect.

41. No Waiver

If XR Masters does not immediately enforce a provision of these Terms, that does not waive our right to enforce that provision later.

A waiver is effective only where legally valid and expressly made.

42. Entire Agreement

These Terms, together with the MyGeoVerse Privacy Policy and any additional terms that expressly apply to a particular Service, constitute the agreement governing your use of MyGeoVerse.

Separate written agreements between XR Masters and a customer, Testbed Partner, institution, developer, or other organization may contain additional or different terms.

Where a separate written agreement expressly governs an organizational deployment or Testbed Program, that agreement will control to the extent of a direct conflict concerning that deployment.
